Advice for citizens Scotland has called that landlords could be banned entirely from the market if they illegally evict their tenants.

Aoife Deery, social justice spokesperson for Citizens Advice Scotland, said: Why mandatory training and tougher penalties such as bans and fines for dishonest landlords should be considered part of upcoming housing legislation.
“Wrongful evictions and resident harassment are often difficult to recognize or go unreported, so they don’t have the clearest picture in the nation, but what this report shows is the coronavirus pandemic. It means that illegal evictions did not decrease during the pandemic.We also found that people who sought advice about illegal evictions often needed other help, such as with benefits or legal proceedings. The charity said it had seen unacceptable behavior, including a mother from West Scotland who was notified to leave her rental property in July 2021 because the landlord’s son needed the home.
The client and his family moved in January 2022. Shortly after this, they learned that the house had been put back on the rental market, with an additional £300 monthly rent, and that the landlord’s son was still living outside the UK.
In another, a mother of two young children asked for help after being illegally evicted. Their landlord was not registered and did not hold her deposit in the Tenant Deposit Scheme.
The landlord gave her an eviction notice, but when she did not move out the day the notice expired, the landlord did not go to the house and property room.
Instead, he put himself in the property, changed the keys when she was out, and removed her belongings and left them on the street.
The client has not returned the deposit to her. Because of the confusion she had to file as homeless with two young children, she had a three-month time limit to file a lawsuit with the Housing and Property Chamber of Commerce related to the rental bond. I was unable to complete the document.
Deery adds: People are being denied temporary accommodation even when they have nowhere else to go because the tenancy agreement provided by their landlord is inaccurate or absent altogether.
“It is totally unacceptable for people to face barriers to accessing homeless assistance when they need it. City councils need to rethink how they support those affected by illegal evictions.
“Not enough people know about their rights when it comes to the difference between legal and illegal evictions. Challenging this practice is often difficult, especially in the face of threats to the safety of tenants. We need to make the system more robust so that governments and local governments can act quickly against illegal evictions.”
