Donald Trump has found a workaround to a newly expanded gag order that prohibits him from attacking the daughter of a Democratic campaign aide to a judge who gave him hush money. Instead, he attacks her daughter by filing legal documents.
President Trump himself has refrained from attacking Lauren Marchan, the daughter of New York Supreme Court Justice Juan Marchand, at least since a judge expanded the gag order on Monday night.
But by Tuesday night, Trump’s lawyers were on the attack.
In the new declarationthey asked the judge to recuse himself from the case, where jury selection is scheduled to begin April 15 in Manhattan.
What are their proposed reasons for decline? The defense argued that Lauren Marchan’s work on behalf of leading Democratic politicians such as Joe Biden and Kamala Harris created a conflict of interest for her father, a judge.
They argued that the daughter was “making money” from President Trump’s legal woes through her left-leaning political consulting firm, Authentic Campaigns, and that her father, a judge, was somehow complicit.
A letter to the judge Tuesday night signed by defense attorneys Susan Necheles and Todd Blanchet said: “Authentic has received millions of dollars from organizations associated with President Trump’s political opponents since the indictment was returned. “We are being paid in dollars.”
“Some of these funds were paid to Authentic by entities associated with members of Congress and PACs that used email and social media to solicit donations based on this case,” the letter continued.
“Therefore, there is strong evidence that Authentic took advantage of this lawsuit to make money,” the letter claims.
“There is an unacceptable risk that the family relationships of the court will influence judicial conduct,” the letter concludes.
The letter asks Merchan for permission to expand on the denial request by filing “a motion in support of these claims, including explanation and evidence, on Wednesday, April 3, 2024.”
Lauren Marchand did not respond to repeated requests for comment. Manhattan prosecutors did not immediately respond to the request for revocation, but called Trump’s attacks on the judge’s family “dangerous” and “reprehensible.”
Prosecutors argued Monday President Trump’s personal attacks on those involved in the cases “threaten the integrity of these proceedings and are intended to intimidate witnesses and trial participants, including this court and the judges alike.” Stated.
On Tuesday night, prosecutors said: in your own submission In August, a judge reportedly denied a similar request by the defense to recuse the case.
Prosecutors countered Tuesday night, saying, “This court and the Judicial Ethics Advisory Committee have already determined that such claims are not grounds for dismissal.”
In August, the state Ethics Commission pointed to a finding by prosecutors that “a relative’s independent political activities do not constitute a reasonable basis for questioning the judge’s impartiality.”
The judge did not immediately rule on Tuesday’s request to accept the new recusal request, but he has consistently rejected previous defense arguments that the daughter’s consulting work poses a conflict of interest. .
Judges have also repeatedly warned the defense against increasing frivolous delaying tactics because of the penalties for finding Trump’s lawyers in contempt of court.
